Answer: This is a hard one. First off, it’s going to vary a good bit by where you’re located. It varies from county to county. You would think there would be a consistency, but there are actually some counties that a person will go to jail on their first time DUI; other counties it may be the second or third. So, it’s a rather difficult question to answer. I mean, a lot of jurisdictions, even a first time felony, you won’t go to jail. But there are places you definitely will. Other side of it is, a DUI, if there is a death involved, I think you pretty well, the likelihood is very strong that you would go to jail there.
