Answer: This can happen on a first-time offense—somebody that has never had involvement with law enforcement in their lifetime. If a person has a child in a vehicle that they have any degree of control over and they are charged with DUI, it will be filed as a felony child endangerment charge and carries up to four years in prison and up to a $5,000 fine. This can include what we refer to as ABC, meaning they were sitting in a parking lot somewhere with the child in the car and they were found to be intoxicated, they would be facing this type of criminal proceedings.
