Oklahoma Improper DUI Stops
DUI arrests almost always occur when the police pull someone over. Once a person has been stopped, law enforcement can ask him or her to complete field sobriety tests and/or a chemical test. If the results indicate intoxication, the driver will be arrested.
Reasons for Stopping
It is important to understand that the police must have a valid reason for pulling the car over—an improper lane change, speeding, or another moving violation. The police cannot legally stop a vehicle for:
- Weaving in the lane, as there is any number of reasons as car could move within a lane.
- An offense that another car commits.
- An officer’s hunch that the driver is drunk.
Even if the driver is over the legal driving limit for BAC, an improper stop would invalidate the arrest and all evidence surrounding the arrest.
