Hunsucker, Edge v. Fallin 2017 OK 100
Edge Law Firm associated with Hunsucker Legal Group and is responsible for defeating a horrible new law in Oklahoma – Hunsucker, Edge v. Fallin 2017 OK 100. This law had many horrendous new burdens on the driving public. Through the dogged determination of Bruce Edge and John Hunsucker it was taken to the Supreme Court and declared Unconstitutional! Edge Law has a strong track record of getting suspensions overturned and going on to have DUI charges reduced or dropped altogether
The License Suspension Process
When you are pulled over for a DUI, the officer will ask you to take a breathalyzer or blood alcohol test. If those tests come back positive or if you refuse to take them, the officer will issue an “Officer’s Affidavit and Notice of Revocation/Disqualification.” This is your notice that your license will be suspended 30 days after you are issued the Affidavit. Even if you are eventually acquitted of the criminal DUI charge, your license will still be suspended for a minimum of six months and as many as eight years.
How to Appeal a License Suspension
Before your license suspension takes effect, you can appeal and retain your driving privileges. The lawyers at Edge Law Firm will work with you to request a hearing with the Oklahoma Department of Public Safety (DPS). However, you only have 30 days to request a hearing after your arrest. The Edge Law Firm DPS attorney then begins his fight to save your license.
It is absolutely critical that you reach out to a lawyer as soon as possible. If this 30 day period is missed, you lose all opportunity to win your license back.
