Question: Can you explain actual physical control in Oklahoma?

Answer: Actual physical control, commonly referred to as APC, is punished under the same code and punished identically to DUI; same punishment. The only difference between the two is is that the vehicle doesn’t necessarily have to be actually moving; you just have to be in a position and have the ability to control the movement of that vehicle. For instance, if you were in a parking lot with the keys in your pocket and passed out, you would be APC.
