Understanding the Ignition Interlock Device
Installed on your car’s ignition, an IID is a device which controls whether or not the car will operate based on the driver’s Blood Alcohol Content (BAC). Before the vehicle will start, they must breathe into the device. If it registers any alcohol, it will disable the vehicle. In addition, it may request tests at random intervals while the car is in operation, triggering an alarm and requiring the driver to pull over if it detects the presence of alcohol. In either case, the IID will log the failure in its system.
Potentially Bypassing the Ignition Interlock Device with an Appeal
It may be possible to bypass the Impaired Driver Accountability Program (IDAP) altogether and spare yourself the expense of having an IID installed in your car. To do so, drivers and their attorney must submit a written application within 30 days of receiving a revocation notice.

The Appeal Hearing Process
An administrative fee is required to schedule a hearing, which consists of a a non-jury trial before a judge. You are not required to attend the hearing, as your attorney is allowed to advocate on your behalf. During this hearing the burden of proof will fall on the Department of Public Safety (DPS), and Service Oklahoma (SOK. The nature of this burden will differ based on whether or not your refused a breath test, but essentially the State will have to prove:
- That the officer who initiated the stop had probable cause to do so, based on the evidence at hand.
- That the driver tested over the legal limit of .08 percent, or refused the test.
- That the driver was in control of the vehicle, either as the driver or while in Actual Physical Control (APC) which can mean you were simply sitting in the vehicle.
- That the driver was fully informed of the consequences involved with the test, either in taking it or refusing it.
- That the arrest was legally sound, without any mistakes or discrepancies on the part of law enforcement.
Mistakes with any of these issues can provide all the justification needed to restore your driving privileges and avoid the use of an ignition interlock device.
