Marijuana Under Oklahoma State Question 788
The passage of State Question 788 means that medical use and possession of marijuana is now legal in the state of Oklahoma. This does not, however, mean that marijuana is completely legal to use freely; a person can still be arrested for possession or use in certain circumstances.
Marijuana DUI’s
The legalization of medical marijuana is a major change in the laws surrounding the drug. It means with a physician’s approval, a person can legally possess and smoke marijuana in his or her home. While this is a step forward, there are still laws that citizens of Oklahoma must be aware of. For example:
- Even if a person is legally allowed to use marijuana, they are not allowed drive or operate heavy machinery while under its influence.
- An arrest for driving under the influence of marijuana is a DUI in Oklahoma in the same way driving under the influence of alcohol is a DUI.
- The police may have difficulty proving that marijuana impaired a driver, so arrests for marijuana DUIs often have more questions and gray areas than alcohol DUI cases.
State Question 788 has opened the door for legal marijuana possession in Oklahoma, but it is not completely legal yet, nor have the laws around its usage firmly been established.
