During the course of a driving under the influence (DUI) arrest in Oklahoma, officers may administer a number of tests to determine probable cause and collect evidence proving an individual’s guilt. However, these tests are not always accurate.

Field Sobriety Tests

Developed by the National Highway Traffic Safety Administration (NHTSA), the standardized field sobriety tests are used to determine if a driver is intoxicated. There are a number of things that can go wrong during the administration of these physical tasks, which are detailed below:

Chemical Tests

Oklahoma has placed limits on the amount of alcohol a driver can have in his or her system before being arrested for DUI—even if his or her ability to operate a vehicle was not compromised by the consumption of alcohol.
